PRIVACY POLICY

Framkat LP/Framesi North America (“Framesi” or “us” or “we” or “our”) owns and operates the framesiprofessional.com and morphosiscleanbeauty.com websites (the “Sites”).  This Privacy Policy (“Policy”) contains details about how Framesi collects, uses, maintains, and shares your personal information and other data when you use the Sites or any other website or mobile app where this Policy is posted or published, or when you otherwise interact with Framesi, whether on social media, by phone, in writing, in person, or otherwise (all of which will be referred to collectively, together with the Sites, as the “Services”). This Policy also explains how you can exercise certain rights or choices you may have in connection with your privacy and the information we collect from you.

This Policy covers only the Services identified above, and does not apply to information which you may send us by other means.  Other sites, apps, or other online locations, including any social media platforms or services you may use to interact with Framesi, may have their own privacy policies or notices which apply instead of this Policy, and you should consult those accordingly.

The Services are directed at individuals located within the United States, Canada, and the Caribbean. Framesi only knowingly collects information from individuals within these areas. If you use the Services in other locations, you do so at your own risk and you understand and agree that your personal information (as defined below) will be accessed, used, and stored in the United States, which may not have the same level of privacy protections under applicable law as compared to where you may reside.

The Services are intended for users eighteen (18) years of age or older. If you are not 18 years of age or older, you are NOT permitted to access or use the Services.  If you learn that anyone younger than 18 has unlawfully provided us with personal information, please contact us, and we will take steps to delete such information.

This Policy is effective as of: March 31st, 2026.

Policy Changes ——————–

Framesi may update this Policy from time to time.  When we make any changes to this Policy, we will post a notification on our Sites and update the Policy’s effective date.  The changes will also be immediately incorporated into this Policy. You acknowledge and agree that it is your responsibility to review this Policy periodically and become aware of modifications.

Your continued use of the Services after any changes are made to this Policy constitutes your acceptance of the changes.  If any of the changes are unacceptable to you, you should cease using the Services.

If any changes to this Policy will materially affect how Framesi handles or shares personal information that Framesi already collected from you, Framesi will provide appropriate notice to you and obtain your consent to the changes as necessary to comply with applicable law. If you do not consent to such changes, your personal information will continue to be used in a manner that is consistent with the version of this Policy under which it was collected, or the information will be deleted.

Collection of Information ——————–

Personal information is generally defined as information that, by itself or in combination with other data, is reasonably capable of being associated with you or your household or device.

Certain parts of the Services may ask you to provide Framesi with personal information voluntarily.  For example, personal information such as your name, salon name, telephone number, email address, mailing address, credit/debit card number or other payment information, username and password or other account access information, and salon or student ID number, as well as inferences based on the foregoing, may be collected from you when you:

  • contact Framesi with questions or comments, or request information about Framesi products;
  • participate in surveys, questionnaires, sweepstakes or contests through the Services;
  • sign up to receive Framesi’s email newsletter or text messages;
  • request that Framesi send you sample products;
  • request information on where Framesi products are sold;
  • set up an online account to purchase Framesi products;
  • order/purchase Framesi products; 
  • request Framesi products as rewards (Elite members); and/or
  • communicate with us or seek information in connection with other activities, services, features, or resources we make available on or through the Services.

You may provide us with certain location information whenever you use the locator pages on our Sites to find distributor stores, salons, and sales consultants near you. These locator Services include a widely used application programming interface or API which can determine the precise GPS location of your mobile device or computer, but only if you provide your consent. For example, your device or its browser may ask you to “Allow this site to access your location?” and you may be able to respond with options such as “Allow this time” or “Always allow” or “Never for this site.” If you deny permission for precise location tracking, then the locator Services will only use any address, ZIP code, city, state, or other location information that is manually entered into the locator search function.

Otherwise, we will not ask you to provide us with sensitive personal information about yourself, such as your sexual orientation, citizenship status, religious beliefs, biometric or medical information, or your race or ethnicity, and we ask that you do not provide such sensitive information to us when you interact with our Services. To the extent you choose to disclose any precise location data or other sensitive personal information to Framesi, you hereby acknowledge and agree that such sensitive personal information may be processed by us in accordance with the terms of this Policy. 

Depending on the nature of the activity, such as if you publicly upload or post content with sensitive or other personal information for viewing on or through the Services, other users may be able to view that information.  Framesi reserves the right to modify or delete any content you upload or post on or through the Services.

Online Tracking Technologies

There are other areas of the Services where personal information or other data may be collected from you in an automated manner. When you visit or use certain Services, for example, we may automatically collect certain device information about your computer, browser, or device that includes data such as your IP address, time zone, and some of the cookie identifiers that are installed on your device. Framesi will treat such device information as personal information to the extent such device information is reasonably capable of identifying a particular individual.

More specifically, the Sites may use “cookies.”  Cookies are files that are transmitted to your computer, browser, or device when you visit a website.  Cookies allow Framesi to recognize your browser when you subsequently return to the Sites.  Cookies may also collect your user preferences when you use our Services.  Framesi uses cookies to improve the performance of the Services. You may be able to delete or disable cookies by consulting your browser, device, and/or computer instructions.  Please note that any deletion or disabling of cookies could affect how the Services appear and/or operate for you.  

The Services may include “pixels” which are small image files embedded within a website that can be used to gather information about your device and browser. Additionally, tracking pixels can be used on emails to help track the success of email communications by seeing when you open an email and/or click on any embedded links. Information collected through the use of pixels may include your IP address or metadata derived from your IP address, along with information or inferences based on your activity while using the Services such as: (a) which pages you viewed, (b) what ads, links, or other content you clicked on while interacting with the Services, (c) the prior websites you visited, (d) your preferences and interests, (e) your general location (city, state, and country), and/or (f) your transaction history on or through the Services. This pixel information is then used for (i) analytics purposes to understand and improve how users interact with the Services, and (ii) for advertising and marketing purposes. Pixel information may be shared with third-party advertising vendors for targeted advertising purposes as described below. 

Framesi may use the foregoing third-party advertising technology to serve advertisements to you on other sites or other online locations.  The technology gathers data about your visits to the Sites and other locations where Framesi advertisements appear in order to serve you with Framesi advertisements elsewhere online.  When these advertisements are served to you, third-party cookies also may be put on your computer or device. 

For example, Framesi uses AdRoll (www.adroll.com, https://www.nextroll.com/privacy) to serve you customized advertisements on third-party locations based on your interaction with the Sites.  As you browse the Sites, advertising cookies may be placed on your computer so that Framesi can understand what you are interested in on the Sites.  AdRoll allows Framesi to present you with targeted advertising on other sites you visit based on your previous interaction with the Sites and other online locations.  Please visit https://thenai.org/how-to-opt-out/ for more information on how you may be able to opt out of AdRoll and its partners’ targeted advertising.  

Framesi also uses third-party providers of tracking technologies such as Tracklution to provide analytics services about how you and others use our Sites. Google Analytics

Framesi may also use third-party service providers which collect and aggregate information to analyze how users interact with certain Services, in order to optimize the performance of such Services. For example, the Sites may use Google Analytics, which is a web analytics service that uses online tracking tools to analyze how you use aspects of the Sites. The information collected by this third-party service about your use of the Sites (including page views, scrolls, videos or links that were clicked, a unique client ID attributable to your device and browser information, your approximate age, gender, interests, language settings on your device or browser, and approximate location metadata derived from your IP address (city, state, and country)) is transmitted to and stored on a Google server in the United States. Google uses this information to assess your use of the Sites, providing reports on data such as how often you visit, what pages you view when you visit, and what other websites you visited prior to visiting or using our Sites, for example. Google may transfer this information to third parties, if required by law or if third parties process the information on behalf of Google.

Third-Party Plugins

Our Services include links or buttons that interact with third-party plugins or other tools that are used to connect our Sites to our accounts on social media platforms as well as for data analytics and targeted advertising purposes. By using these third-party plugins or other tools, information about your use of the applicable platform, your device, and your activity on the Sites (including which webpages you may have viewed) could be shared with such third parties.  You may be able to opt-out of being tracked through these online tools by following instructions available through links in the table below.

Use of Information ——————–

Framesi may use your personal information and other data to:

  • respond to questions or comments you have about Framesi or Framesi products;
  • deliver services through the Sites at your request;
  • process and catalog responses to surveys or questionnaires;
  • enter you in contests and sweepstakes you participate in through the Services;
  • set up your online account to purchase Framesi products;
  • send you Framesi newsletters and other product updates;
  • send you Framesi educational class and/or event information and updates;
  • send you Framesi products ordered/requested by you;
  • send invoices for purchased Framesi products;
  • provide feedback on where Framesi products are sold; and/or
  • improve the content and general administration of the Services.

As stated above, we do not knowingly collect your sensitive personal information and in the event that you voluntarily provide us with your sensitive personal information, we will not use it for profiling purposes or to infer characteristics about you. We do not use algorithms or other tools to make automated decisions about you.

SMS/Text Message Communications

We may send you SMS or text messages that include updates, alerts, and other promotional information about our products and Services, and such messages may be sent using an automatic telephone dialing system or other automated technology. You must consent to receive automated SMS or text messages. By consenting to Framesi’s SMS/text messaging Service, you agree to receive recurring SMS or text messages sent by or on behalf of Framesi to the phone number you provided, even if that phone number is registered on any state or federal Do Not Call list.

You understand that you do not have to sign up for the SMS or text messaging program as a condition of purchasing or using Framesi’s products or Services. Your participation in Framesi’s SMS/text messaging Service is completely voluntary. 

You may opt-out of receiving automated SMS or text messages sent by or on behalf of Framesi at any time. If you wish to opt-out of receiving automated SMS or text messages from Framesi, please reply with STOP or otherwise follow the unsubscribe or opt-out instructions in any such message. You may receive a one-time opt-out confirmation text message, but no further messages will be sent to your mobile device unless initiated by you. 

For support or assistance related to Framesi’s SMS/text messaging Service, text HELP in response to any message you receive or contact Framesi using the information at the end of this Policy.

Framesi may change any short code or telephone number we use to operate the SMS/text messaging Service at any time and will use commercially reasonable efforts to notify you of these changes. You acknowledge that any messages you send to a short code or telephone number we have changed, including any STOP or HELP requests, may not be received and we will not be responsible for honoring requests made in such messages. You agree that you are responsible for providing and maintaining a valid and accurate mobile phone number for use in connection with Framesi’s SMS/text messaging Service. If you plan to get a new phone number, then you must opt-out of Framesi’s SMS/text messaging Service prior to changing your number and sign up for this Service again with the new number. Framesi and any applicable mobile phone or wireless carriers are not liable for any delayed or undelivered messages.

Standard data usage fees may be charged by your mobile phone or wireless carrier when receiving SMS or text messages, so please be aware of such fees.

By providing to Framesi the personal information and other data referenced above, you agree that Framesi may use the personal information and other data in accordance with the terms of this Policy.

Sharing of Information ——————–

Framesi may share certain personal information with the U.S. Postal Service or other shipping entities in order to ship any requested product samples or ordered products to you.  Framesi may use email marketing vendors such as HubSpot (for more information see HubSpot’s privacy policy) and chatbot services from third-party providers who could receive or have access to your personal information or other data in order to communicate with you about our Services. Framesi may also share personal information with payment processors to process any purchases made through the Services.

Framesi will disclose your personal information or other data if it reasonably believes it is required to do so by law or in cooperation with a governmental or law enforcement investigation.  Framesi may also share personal information or other data in order to avoid imminent physical harm to any person or harm to any Framesi property.

In certain cases, Framesi may share your personal information or other data with additional third parties, including:

  • our related companies to contact you about relevant products or services;
  • our business partners and/or marketing affiliates to assist with a particular promotional activity or to help us improve our products to better serve your needs; and/or
  • an acquiring entity or other third party if Framesi’s ownership status changes, such as if we are involved in a merger, acquisition, or asset sale.

You acknowledge that such a merger, acquisition, or other transfer may occur, and that any acquiring party of Framesi or its assets may continue to use your personal information as set forth in this Policy.

As described in the “Online Tracking Technologies” section, above, the Services may allow you to share data, including personal information, with other third-party services and social media platforms, such as Facebook and Instagram, when you click on the respective social media button on our Sites. We do not share your personal information with these social media providers unless you direct the Services to do so. Any social media platform or other third party’s use of the information will be governed by their privacy policies, and you may be able to modify your privacy settings with these entities. Links to the respective social media policies and information on how you may opt out of certain sharing that occurs through these social media services are located in the “Social Media Plugins” section, above. Please consult these third parties’ privacy policies before using their platforms to make sure you are comfortable with the level of sharing.

Framesi further reserves the right to use, retain, or disclose any information as needed to satisfy any law, regulation, or legal request, to protect the integrity of the Services, to fulfill your requests, or to cooperate in any legal investigation.

Other than what is referenced above, the personal information and other data collected from you is not shared with or sold to any person or entity outside of Framesi.

Your Rights and Choices ——————–

Your provision of personal information and other data to Framesi means you agree that we may collect, use, and disclose your information according to the terms of this Policy. If you do not agree with these terms, please do not provide any personal information or use our Services. However, certain Services can only be used properly if you provide your personal information to Framesi.

In connection with Framesi’s collection and use of your personal information, and depending on where you reside, you may have a right to:

  • Confirm whether Framesi has collected and is processing your personal information and, if so, you may have a right to request access to or correction of your personal information;
  • Obtain a copy of personal information that Framesi maintains about you in a portable and readily usable format, if technically feasible, that would allow you to transfer such personal information to another service or provider, where the applicable processing is carried out by automated means;
  • Opt out of any processing of your personal information for the purposes of, as applicable and subject to contractual and legal restrictions, (1) targeted advertising based on your browsing behavior before and after you visit or use the Services, (2) any sale of your personal information, (3) any profiling or automated decision-making processes that would produce legal ramifications or similarly significant real-world effects on you, or (4) with respect to sensitive personal information (if applicable), inferring characteristics about you, subject to certain conditions;
  • Request details on the specific pieces of personal information that Framesi has collected about you;
  • Request that Framesi delete or properly dispose of copies of personal information it has collected about you, subject to contractual and legal restrictions; 
  • Not be discriminated against, in terms of the quality and prices offered in connection with our Services, because you exercised these rights regarding the collection, use, and sharing of your personal information; and
  • Submit an appeal to a regulatory authority if we reject your request to exercise any of these rights (if applicable).

You may grant an authorized agent written permission to submit requests regarding your personal information, but we may deny authorized agent requests absent proof that you authorized such agent to act on your behalf, or if we are unable to verify your identity.

Framesi is required to verify the identity of any person or entity that requests the disclosure or deletion of personal information. Making a verifiable consumer request does not require you to create an account with us, but if you have a password-protected account, we will use our existing authentication procedures to verify your identity. For most other requests, Framesi will ask you to provide information that matches at least two pieces of personal information we store about you before responding to your request. If you would like to request the specific pieces of your personal information that Framesi has collected, or if you would like us to delete highly sensitive information, you will need to match at least three pieces of information we store about you, and you must provide a signed declaration under penalty of perjury that you are the individual whose personal information you are requesting. We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. Under such circumstances, Framesi may follow up with you for additional information as reasonably necessary to authenticate your request. Subject to applicable legal requirements, if Framesi refuses to act on a request you make based on the rights listed in this section, you may have a right to submit an appeal by contacting us using the same method as when you made the initial request. In the event Framesi must deny your appeal, we will provide a way for you to forward your complaint to the appropriate legal authorities.

Any removal of information or content by Framesi does not ensure or guarantee complete or comprehensive removal in all places. The content or information may have been shared or reposted by other parties, or federal or state law may require maintenance of the content or information. Framesi will do its best to accommodate your request to delete personal information we collected from you, but Framesi cannot guarantee it can remove all personal information from the specified uses.  Therefore, please be as specific as possible in your request. If the request relates to information that Framesi needs to make the Services function properly for you, you may not be able to use the Services properly moving forward.

Please note that Framesi reserves the right to maintain proper business records as required by law, even if such records contain your personal information.

Framesi’s Services will attempt to respond to or process “do not track” or similar technical requests not to be tracked for targeted advertising.  To learn more about other ways to possibly opt out of certain kinds of tracking that could result in you receiving targeted advertising based on your behavior online, visit the Network Advertising Initiative website and the Digital Advertising Alliance website. You can also change your browser’s cookie settings to block/delete cookies by going to the browser settings page (see, e.g., Chrome, Safari, and Firefox). Options you select through these third-party services are browser- and device-specific, and there is no guarantee that these industry-provided opt-out tools will prevent all targeted advertising. As noted previously in this Policy, it is possible that third parties may collect or receive information through the Services. Since it is possible that some of these third parties may respond differently than Framesi to “do not track” and similar requests, you should consult the applicable privacy policies of those third parties for that information.

Data Security and Retention ——————–

Framesi’s Services use, implement, and maintain industry-standard technological security measures that are reasonably designed to help protect your personal information from loss, unauthorized access, or disclosure.  Framesi uses transport layer security (TLS) or secure sockets layer (SSL) encryption to help prevent unauthorized access to personal information you transmit through the Services.

While Framesi takes the issue of protecting your personal information seriously, you should exercise discretion in what information you disclose and/or transmit online, including on the Sites or through any of our other online Services.  Framesi cannot guarantee that information sent online is fully secure, to the extent any transmitted information may be intercepted by others before it reaches Framesi.  If you are concerned about sending information to Framesi online, please send the information by mail or call us to make other arrangements.  Framesi is not responsible for the security of information sent over the Internet.

Framesi takes steps to make sure that any personal information shared with third parties is only used for the specified purposes and that it will not be shared beyond those third parties unless it is necessary to complete the specified task.

Framesi retains collected information for a reasonable amount of time in order to fulfill the stated purpose for which the information was collected or for other legitimate purposes such as ensuring the security of our data and systems, complying with our legal obligations, complying with tax, audit, or other recordkeeping policies, resolving disputes, conducting internal investigations, and enforcing our agreements or other legal rights.  Due to the different purposes for retaining your personal information, the actual retention timeframes may vary depending on the type of personal information we collect from you and the purposes for which we use your personal information. Framesi reserves the right to retain collected information connected to business records for periods of time required by law, or for otherwise legitimate business purposes to the extent permitted by law, even if such records contain your personal information.  Finally, Framesi will maintain some collected information as part of its customer list. If Framesi determines that collected information is no longer needed, it will delete such information.  Our collection times will be consistent with applicable law. 

Children’s Privacy ——————–

The Services are intended for individuals 18 years of age and older.

The Services are not directed at, marketed to, nor intended for, children under 18 years of age.  Framesi does not knowingly collect any information, including personal information, from children under 18 years of age.  If Framesi learns that any information was provided through the Services by a person younger than 18 years of age, Framesi will delete the information immediately.

International Concerns ——————–

This Policy only addresses data collection from individuals within the United States, Canada, and the Caribbean.  You also agree and acknowledge that by providing any information, including personal information, through the Services, that such information will be transmitted to, and stored in, the United States.

The Services may contain links to external sites not controlled by Framesi.  Framesi is not responsible for the privacy practices and data collection policies for such third-party sites.  You should consult the privacy policies of those sites for details.

As described above, Framesi may allow interaction between the Services and other sites or mobile applications such as Facebook or other social media providers.  This may include the “Like” button or other plugins available through the Services that allow you to share information with persons outside of the Services.  Please consult the privacy policies of those third-party providers before using them to make sure you are comfortable with the level of sharing.
